Web Hosting Terms and Conditions
General Terms

We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots.

You may not store more data in your account than your allotted virtual server space.

You may not exceed the bandwidth agreed on your hosting account in any one calender month. If you do so you agree to pay an excess charge of £1 for every 100Mb (or part thereof) that exceeds the limit. Excessive bandwidth usage may result in the site being temporarily suspended until the end of the calendar month, we reserve the right to decide what constitutes excessive bandwidth usage.

Your virtual server (inc FTP access) is for your personal/business use only. You must not divulge any usernames or passwords to any other person, and you should take reasonable precautions to ensure that they are not discovered by other people.

Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your virtual server.

You may not run server processes (eg. talkers/IRC Bots) from your virtual server.

We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.

When your account is closed all files (including web pages online databases, etc.) will be deleted.

We reserve the right to cancel your account at any time without notice in the event of any of these terms being broken.

We reserve the right to amend and update these Terms and Conditions at any time without notice.

To protect your privacy we never distribute your name or e-mail address to any third parties unless legally obliged to.

Users must not participate in any form of un-solicited bulk e-mailing or spam. Failure to observe this restriction will result in the site being deleted and any costs incurred by us as a result of the spam mail being charged to you. See below for more details of our spam mail policy

By asking us to host a site you are indicating your acceptance of these Terms and Conditions.

Hosting of sites will continue until you ask us to cancel the service, 30 days notice of cancellation is normally required.

Failure to pay hosting invoices by the due date will result in the web site being suspended. Such sites will be deleted from the server 30 days after suspension.

Any payments returned by banks or credit card companies will incur a £25 admininstration fee. This will be invoiced and added to the amount outstanding.

Any software installed on the server must be kept up to date including all security patches released by the authors.

Web Pages

Commercial use of web and ftp space is permitted. You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.

You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).

We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.

We do not allow adult, warez or illegal MP3 web sites on our servers.

Spam Mail

Users are prohibited from engaging in improper use or distribution of electronic mail ("e-mail") Users are strictly prohibited from engaging in any of the following activities:

* Sending unsolicited mass or commercial e-mail ("spamming") for any purpose whatsoever.

* Having third parties send out commercial emails on any user's behalf .Using Forest Software facilities to receive replies from unsolicited emails (commonly referred to as "drop-box" accounts).

* Configuring any email server in such a way that it will accept third party emails for forwarding (commonly known as an "open mail relay"). If a site has roaming users who wish to use a common mail server, the mail server must be configured to require some form of user identification and authorization.

Mass or commercial email may be sent only to recipients who have expressly requested receipt of such e-mails, by the sending of an email request to the person performing the mass or commercial mailings. This exchanging of requests, acknowledgements, and final confirmations (commonly referred to as a "double opt-in" process) must be adhered to in their entirety for any mass or commercial email to be considered "solicited" by Forest Software.

Users that send mass or commercial e-mail are required to maintain complete and accurate records of all e-mail subscription requests, specifically including the email and associated headers sent by every subscriber, and to immediately provide Forest Software with such records upon request of Forest Software. Subscriptions that do not have a specific recipient generated email request associated with them are invalid, and are strictly prohibited.

In the absence of positive, verifiable proof to the contrary, Forest Software considers complaints by recipients of e-mails to be de-facto proof that the recipient did not subscribe or otherwise request the e-mail(s) about which a complaint was generated
